Ogle County Supervisor of Assessments and Planning & Zoning Committee Met July 13.

Here is the minutes provided by the committee:

The regular monthly meeting of the Supervisor of Assessments and Planning & Zoning Committee of the Ogle County Board was held at 10:00 A.M.

The Order of Business is as follows:

1. ROLL CALL AND DECLARATION OF A QUORUM

Chairman Fritz called the meeting to order at 10:02 A.M. Roll call indicated seven members of the Committee were present: Asp, Hopkins, Janes, Smith, McKinney, Youman and Fritz were present.

2. READING AND APPROVAL OF REPORT OF JUNE 8, 2021 MEETING AS MINUTES

Mr. Fritz asked for a motion regarding the report of the June 8, 2021 regular meeting. Mr. McKinney made a motion to approve the report as presented. Seconded by Mr. Janes. The motion carried by a 6-0 roll call vote.

3. REVIEW AND APPROVAL OF CLOSED MINUTES PER 5 ILCS 120/2 (21) (IF NEEDED) Approval of Closed Minutes (if needed)

There were no closed minutes for approval.

SUPERVISOR OF ASSESSMENTS PORTION OF MEETING:

Tricia Black was present representing the Supervisor of Assessments office and will be representing this office until further notice.

4. CONSIDERATION OF MONTHLY BILLS OF SUPERVISOR OF ASSESSMENTS, AND ACTION

Ms. Black presented the monthly bills of the Supervisor of Assessments for three claims for consideration in the amount of $1,338.00. Mr. Hopkins made a motion to approve the payment of the bills as presented. Seconded by Mr. McKinney. The motion to approve carried by a 7-0 roll call vote.

5. OLD BUSINESS

Ms. Black stated the Board of Review is in session. The oath was given to Paula Diehl and Jerry Griffin. Mitch Montgomery was elected as Chairman, Paula Diehl was elected as Vice-Chairman. The BOA discussed amending the meeting rules to allow Zoom call-in as well as in-person but no action was taken. This topic will be on the Board of Review agenda in the future.

The BOR reviewed and countersigned Certificate of Errors issued for Tax Bills in 2021. We have had about five assessors turn in books for 2021 so far. Expecting more this month.

The office is in the process of hiring a person and the job description will be posted on the website.

6. NEW BUSINESS

There was no new business for discussion.

PLANNING & ZONING PORTION OF MEETING:

7. CONSIDERATION OF MONTHLY BILLS OF PLANNING & ZONING DEPARTMENT, AND ACTION

Mr. Miller presented the monthly bills of the Planning & Zoning Department for five claims for consideration in the amount of $387.35. Mr. Janes made a motion to approve the payment of the bills as presented. Seconded by Mr. Smith. The motion to approve carried by a 7-0 roll call vote.

8. OLD BUSINESS (CONSIDERATION AND POSSIBLE ACTION)

#003-21 AMENDMENT - Julie Ann Harwath, 4295 Mount Pleasant Rd., Sherrills Ford, NC for an Amendment to the Zoning District to rezone from AG-1 Agricultural District to IA Intermediate Agricultural District

Approved by RPC 4-0 ~ Approved by ZBA 5-0

9. NEW BUSINESS (CONSIDERATION AND POSSIBLE ACTION)

There was no new business for consideration.

10. MOBILE HOME APPLICATIONS (CONSIDERATION AND POSSIBLE ACTION) There were no mobile home applications for consideration.

11. SUBDIVISION PLATS (CONSIDERATION AND POSSIBLE ACTION)

There were no subdivision plats for consideration.

12. NEW PETITIONS FOR PUBLIC HEARING WITH THE ZONING BOARD OF APPEALS

#005-21 SPECIAL USE – Polo Cooperative Association, 3820 S. IL Rte. 26, Polo, IL for a Special Use Permit in the I-1 Industrial District to allow a liquid propane storage and distribution facility on property described as follows and owned by the petitioner:

Part of the Southeast Quarter (SE1/4) of the Southwest Quarter (SW1/4) of Section 21 Township 23 North, Range 8 East of the 4th P.M., Buffalo Township, Ogle County, IL, 18.9 acres, more or less

Property Identification Number(s): 14-21-300-005

Common Location: 3820 S. IL Rte. 26

Mr. Miller stated referrals have been presented to the APZC committee since 1976 and were to inform the committee of upcoming petitions to go before the ZBA. They are not to be voted on as the petitioner cannot be denied due process. Discussion ensued.

13. OTHER BUSINESS (CONSIDERATION AND POSSIBLE ACTION)

Request of John Bearrows, Rochelle, IL to discuss use of motor homes/RVs by property owner in the AG-1 Agricultural District

Site: 10388 E. Hickory Ridge Dr.

Section 17, Flagg Township

Mr. Bearrows was present and gave a brief history of the property in question. Mr. Bearrows stated we need clarification as to whether an owner of property zoned AG-1 Agricultural District can have an RV on the site for personal use. Mr. Miller reviewed Section 16-6-21 of the zoning ordinance and stated #2 would apply to this circumstance which, with this Committees approval, would allow them to store the RV on the site for weekend use. The process is once an application is received, all the adjoining property owners are notified of the request and the meeting date of the APZC committee. They will have an opportunity to voice their concerns at that meeting. If the request is approved, the use would be subject to yearly renewals/reviews by the Zoning office. Discussion ensued regarding building on the site and rezoning options.

Request of Candace Rivera, 304 N. Linn St., Kings, IL to discuss possible rezoning from R-2 Single Family Residential District to B-1 Business District

Site: 304 N. Linn St., Kings, IL

Section 27, White Rock Township

Ms. Rivera was present and stated I have a mobile coffee truck that I have parked in the alley on my property in Kings where we serve coffee & lunch drive thru style through the alley. We originally wanted to park the truck in the front yard along Rte. 64 but that location seemed unsafe. It is only myself and my neighbor that use the alley. The property was originally zoned B 1 Business District and in 2016 we had to be rezoned to R-2 Single-Family Residential District in order to purchase as dwellings were not allowed to rebuilt in the B-1 Business district. We would like to rezone back to B-1 Business District so I can have my mobile truck parked there. Mr. Miller stated in 2016 dwellings were not allowed to be rebuilt if damaged more than 50%. That ordinance was changed last year to allow existing homes in the B-1 Business District to be rebuilt or added on to. Discussion ensued regarding Home Occupations and if allowing this use would set a precedence. Mr. Smith stated I have had numerous calls regarding this. There is already a business like this in the area that is in the correct zoning district. The alley is not safe for traffic and there is all residential use around this site. This proposed use is not conducive to this area. Discussion ensued. Mr. Miller stated for her to be allowed to have this mobile business on her property, it would need to be rezoned to B-1 Business District as this use is not allowed in the R-2 Single-Family District. Ms. Rivera is here today to ask the committee if she can apply to rezone and follow the process. We need a consensus or a vote. Committee consensus was to allow Ms. Rivera to apply to rezone the property to B-1 Business District.

Mr. Smith asked what is the status of the business continuing as it now. Mr. Miller stated we have not issued a cease & desist. Mr. Smith stated this use should not be allowed to continue until the property is rezoned.

14. PUBLIC COMMENT

Mr. Smith asked about the status of the project on corner of 251. Mr. Miller stated the zoning certificate is still valid and they are not in any violation.
