City of East Dubuque City Council met August 13. 

Here is the minutes as provided by the council:

1. 18-0801   Call to Order – Mayor Pro Tem Robey


                     Aldermen Degenhardt, Digman, Robey, Shireman and VanOstrand present. Alderman Arling and City Clerk Arling were absent. Administrative Assistant Gavin and Attorney Kurt were also present.

2. 18-0802   Speakers from the Floor

                    Kristi Alvarado, 490 Montgomery. She attended the July 2, 2018 Council Meeting and presented information regarding an Airbnb in her neighborhood. She also attended the Zoning Board of Appeals meeting on July 26, 2018 with her children, one of which gave testimony. This weekend there was an RV in the yard and at another time a truck from Missouri parked at 500 Montgomery Avenue. Very concerned with it being a short term rental, no background checks, out of state vehicles parked all over the neighborhood. At the zoning meeting, it was disclosed that even hair stylists are required to have mandatory training on sex trafficking. Something very familiar in the current news. Since it is listed as an Airbnb people from other countries have rented the property. She is very concerned with children being at risk. There are two day cares in the area, 3 playgrounds and a bus stop. Kids go back to school, August 24. She had a petition with over 60 signatures to present to the council regarding this issue. It was a pleasure to meet with the neighbors that mean something to you, who didn’t even know what was going on. She loves the small town atmosphere, and it is a great place to raise kids.

                    Diane Havner, 905 Hiawatha. There are lots of rental places on Hiawatha and who knows who they are. Even people living there over six months, don’t change out their license plates.

New Business:

3. 18-0803   Discussion and Possible Action to Accept Resignation of Dan Welp, Mayor for the City of East Dubuque / City Attorney Kurt

                     Alderman Degenhardt Made a Motion to Accept Resignation of Dan Welp, Mayor for the City of East Dubuque, seconded by Alderman VanOstrand. 5 ayes, 1 absent (Arling). Motion carried.

4. 18-0804    Discussion and Possible Action to Nominate and Approve Appointment of Mayor to Fill Unexpired Term Due to Vacancy in the Position / City Attorney Kurt (Swear In)

                     Alderman VanOstrand Made a Motion to Nominate and Approve Appointment of Steve Robey to fill the unexpired term of Mayor, seconded by Alderman Degenhardt. 5 ayes, 1 absent (Arling). Attorney Kurt swore Steve Robey in. Mayor Robey read into record that under Section 65 ILCS 5/3.1-10-50(f) that the alderman designated as acting mayor still votes in his or aldermanic capacity and no vacancy is created for the aldermanic seat, so he is giving up his mayoral power to vote and veto.

5. 18-0805   Discussion and Possible Action to Approve Funding for City Manager Search / City Attorney Kurt, Acting Mayor

                     Alderman Shireman has prepared a job description and ad for City Manager position. He has also contacted John Phillips from ICMA, who wishes to meet with the council. He suggested the ad should reach out to Minnesota, Milwaukee, Chicago and Des Moines area. Alderman Shireman will also research communities under 4,000 population to get estimates of salary range. It would be best to use internet search, no printed ad. Alderman Shireman Made a Motion to Approve Funding Not to Exceed $5,000 for advertising, seconded by Alderman Digman. ROLL CALL: 5 ayes, 1 absent (Arling). Motion carried.

6. 18-0806   Discussion and Possible Action to Approve Knights of Columbus Request to Hold their Annual Tootsie Roll Drive for People with Intellectual Disabilities on Friday, September 21, 2018 from 2 p.m. to 6 p.m. and Saturday from 8 a.m. to noon at the Intersection of Wisconsin and Sinsinawa Avenues / City Attorney Kurt, Acting Mayor, Knights of Columbus

                     Alderman VanOstrand Made a Motion to Approve Knights of Columbus Request to Hold their Annual Tootsie Drive for People with Intellectual Disabilities on Friday, September 21, 2018 from 2 p.m. to 6 p.m. and Saturday from 8 a.m. to noon at the Intersection of Wisconsin and Sinsinawa Avenues, seconded by Alderman Digman. Motion carried. 5 ayes, 1 absent (Arling).

7. 18-0807   Discussion and Possible Action to Approve Special Event Permit and Class D Liquor License to EDGE Group for Sunday Funday Cruise in 8 Corn Boil, to be Held Downtown East Dubuque on Sunday September 2, 2018 from 5:30 p.m. to 8:30 p.m. with Closure of Street from 7 Sinsinawa Avenue to 198 Sinsinawa Avenue for Car Show / City Attorney Kurt, Acting Mayor, EDGE Group

                    Acting Mayor Robey noted that the event will run from 4 p.m. to 10 p.m. Alderman Shireman Made a Motion to Approve Special Event Permit and Class D Liquor License to EDGE Group for Sunday Funday Cruise in 8 Corn Boil, to be Held Downtown East Dubuque on Sunday September 2, 2018 from 4 p.m. to 10 p.m. with Closure of Street from 7 Sinsinawa Avenue to 198 Sinsinawa Avenue for Car Show, seconded by Alderman Degenhardt. Motion carried, 5 ayes, 1 absent (Arling).

8. 18-0808    Discussion and Possible Action to Approve Special Event Permit Application for Wild Hog Fun Run on August 25, 2018 from 10:30 a.m. to Noon and Block off Sidewalks and Parking in Front of Businesses from 240 Sinsinawa Avenue to 292 Sinsinawa; Street Dance to Benefit East Dubuque United from 5 p.m. to 11 p.m. with Street Closure on Wall Street from 240 Sinsinawa Avenue to 292 Sinsinawa Avenue. / City Attorney Kurt, Acting Mayor, Kathy Roth

                     This event will benefit a new Veteran’s Memorial. Alderman Degenhardt Made Motion to Approve Special Event Permit Application for Wild Hog Fun Run on August 25, 2018 from 10:30 a.m. to Noon and Block off Sidewalks and Parking in Front of Businesses from 240 Sinsinawa Avenue to 292 Sinsinawa; Street Dance to Benefit East Dubuque United from 5 p.m. to 11 p.m. with Street Closure on Wall Street from 240 Sinsinawa Avenue to 292 Sinsinawa and two parking spaces beside 292 Sinsinawa Avenue, seconded by Alderman VanOstrand. Motion carried, 5 ayes, 1 absent (Arling)

9. 18-0809    Discussion and Presentation from Gramercy Park Foundation on The Prairie Area Maintenance and Restoration Program / City Attorney Kurt, Acting Mayor, Jeff Trannel

                    Jeff Trannel presented a 3 year rolling contract for the habitat restoration and maintenance of the prairie area marked on the map submitted to the council. He has also submitted standard contract language to the contractor for insurance, etc. The prairie area was established in the past but because of the access, it has been difficult to maintain. This will reestablish and maintain it for the next three years. Alderman VanOstrand asked how many acres, would seeding be required and if burning was an option. It is included in year two. This program will allow the prairie area to develop and hold back the forces of nature. No action required by the council.

10. 18-0810    Discussion and Possible Action to Approve Purchase of SCBA Upgrade Package Presented by the East Dubuque Fire Department / Fire Chief Heim, City Attorney Kurt, Acting Mayor

                        Fire Chief Heim updated the council with the proposals submitted. Ed M Feld has presented a bid of $71,977.1 for 26 upgrade kits. Hydro-Stat Inc. has submitted a bid of $22,800 for 40 4500 PSI 45 minute cylinders. The total cost of the project is $98,777.10 and it was budgeted for $98,614.00. To offset the cost of the project, the fire department has made $12,000 on their picture fundraiser, DRA and JoCarroll Electric grants $6,000, and $4,370 on the TV raffle. The Fire Department was thanked for their efforts to raise money for this purchase. Alderman Shireman Made a Motion to Approve the bid of $71,977.10 from Ed M Feld and $22,800 from Hydro-Stat Inc. for the Purchase of SCBA Upgrade Package Presented by the East Dubuque Fire Department, seconded by Alderman VanOstrand. ROLL CALL: 5 ayes, 1 absent. Motion carried.

11. 18-0811    Discussion and Possible Action to be Taken with Recommendation from the Zoning Board of Appeals Regarding Tourist Rental Homes / City Attorney Kurt, Acting Mayor, Administrative Assistant Gavin

                       Lou Ann Gavin attended and took notes for the Zoning Board Meeting. Included in the discussion was current code. Tourist homes are defined as motels under city language and are restricted to AG and GR zoned parcels and require a special use permit. There are currently three establishments listed with Airbnb services in the city limits. Alderman Shireman Made a Motion Directing the City Attorney to Send Registered Letters to Current Airbnb’s that they will need to schedule a hearing with the Zoning Board requesting a special use to run their businesses, and schedule an Ordinance Committee meeting, seconded by Alderman VanOstrand. Motion carried, 5 ayes, 1 absent (Arling).

12. 18-0812    Discussion and Possible Action to Pass an Amendment to Ordinance Amending Setting the Regular Scheduled City Council Meetings of the City of East Dubuque, Jo Daviess County, Illinois / City Attorney Kurt, Acting Mayor

                        In February 2018 the council approved the change of City Hall hours from 7:30 a.m. to 4:30 p.m. The City Manager extended the closing hours to 5 p.m. Alderman Digman feels the hours of 7:30 a.m. to 4:30 p.m. should stay as approved in February. No further discussion.

13. 18-0813    Discussion and Possible Action to Approve Bid for Installation of a Catch Basin at the Corner of Montgomery and East Streets / Public Works Director Fluhr, City Attorney Kurt, Acting Mayor

                       Public Works Director Fluhr explained to the council that this is a problem area. They have put in a large quantity of rip rap that just washed away. The best solution would be to install a catch basin. He received two bids: Weber Concrete $5,800 and Temperley Excavating $5,000. Alderman Degenhardt Made a Motion to Approve Bid from Temperley Excavating not to exceed $5,000 seconded by Alderman Digman. Roll Call: 5 ayes, 1 absent (Arling). Motion carried.

14. 18-0814    Discussion and Possible Action to Approve Bid for Tree Removal (2) and Additional Stump Removal (10) / Public Works Director Fluhr, City Attorney Kurt, Acting Mayor

                       Public Works Director Fluhr received two bids for tree removal and stump removal. G&R Tree Service $2,600 for removal of two trees, and Cedar Birch $2,675 for removal of two trees and stump grinding (10). Alderman Shireman Made Motion to Approve Bid from Cedar Birch for $2,675, seconded by VanOstrand. Roll Call: 5 ayes, 1 absent (Arling). Motion carried.

Council & Committee Reports:

15. 18-0815     Staff Reports: Acting Mayor Report, Alderman Report

                         Acting Mayor Robey noted correspondence received from Sharon Pepin. He would like her to attend the next council meeting for update on WWT Plant Project. There is a Mayor’s meeting on August 15 in Warren if any alderman would like to attend. We have also received a bid on a new server for the new City Hall. The current server is over seven years old. Mayor Robey and Public Works Director Fluhr met with Tracey Exports on the current annexation and water extension. It would cost over $100,000 to extend the service. It is a mutual agreement that they would like to de-annex until some future time when water services could be extended. We will need to start the process to de-annex.

                        Alderman Shiremen thanked Mark Fluhr on the road improvements made on Montgomery Ave. Appreciates two bids being submitted for projects. Thanked Steve Robey for stepping up to take the position of Mayor.

                        Alderman VanOstrand agree with Alderman Shireman and he had called City Hall staff thanking them for holding up the fort.

                         Alderman Degenhardt thanked Steve Robey for accepting the Mayor’s position and wants to see the city move ahead and make things good again.

                         Alderman Digman agreed with everyone and also the update on Tracey Export.

19. 18-0819     Adjourn Alderman Degenhardt Made a Motion to Adjourn at 6:47 p.m., seconded by Alderman Shireman. Motion carried, 5 ayes, 1 absent (Arling).
