City of Byron City Council met May 28.

Here is the agenda provided by the council:

1. CALL TO ORDER – Mayor Rickard called the meeting to order at 6:30 p.m, and led the council in the Pledge of Allegiance.

2. ROLL CALL – Aldermen present: *Todd Isaacs, Mittzi Fulrath, Dan Reilly, Zeke Hobbie, Michael Gyorkos, Christy Hanlin. Six members present by roll call vote. Quorum established.

3. EXTENSION OF DINING AND BAR SERVICE INTO CITY STREETS – Mayor Rickard has been in touch with several restaurants that wish to have outdoor seating as we move into Phase 3 of Governor Pritzker’s plan to reopen Illinois. None have expressed a desire to extend seating out into the street but Sunrise Restaurant, Swedish Pancake House and Uptown Lanes would like to have seating on the sidewalk. In order to accommodate pedestrian traffic (while keeping six feet apart), concrete barriers will be placed to block parking stalls in order to form a walking path. Alderman Fulrath asked if this configuration is ADA compliant. Chief Murray replied that it is for the most part. Alderman Isaacs asked if the tables should be placed in the street and keep the sidewalk open. Mayor Rickard said the distance between the restaurant and the street would be difficult when serving food, and it places the diners closer to traffic. Alderman Fulrath asked about the public going inside to check in and use bathrooms. Mayor Rickard said check in would be outside, and entry to the building to use restrooms would be one person at a time. A brief discussion took place regarding businesses requiring masks. Alderman Hobbie asked if we can limit capacity. Mayor Rickard explained that it is a Health Department issue. Alderman Isaacs asked if the plans are fine as presented. Director Hewitt said the city asked for layout, hand sanitizing stations, mask and glove requirements for employees, and restroom policy, and the all plans covered these items. Chief Murray said the Aero will not open, and The Cave and Second Chance are operating on their property only. Hairy Cow plans to be open until 9PM. Director Hewitt asked council members if they wish to limit operating hours. After discussion, it was decided not to limit hours. Mayor Rickard asked for certificates of insurance from PrairieView and Swedish Pancake. Attorney Krahenbuhl has concerns about insurance having indemnification agreements if a patron got COVID-19 as a result of these plans. These indemnification agreements are included on all permits. Permits are issued subject to them following all of the stipulations outlined by the Illinois Health Department. Chief Murray and Director Hewitt will collect all certificates of insurance needed and take care of permitting in conjunction with Attorney Krahenbuhl

Mayor Rickard extended the Declaration of State of Emergency until the next city council meeting on June 3, 2020.

Mayor Rickard adjourned the meeting at 6:57 pm.
