City of Prophetstown City Council met July 9.

I. CALL TO ORDER: A regular meeting of the Prophetstown City Council was held at City Hall in Prophetstown, Illinois. The meeting convened at 7:04 p.m., Mayor Steve Swanson, presiding.
II. ROLL CALL: DAN BAKER, DARYL DRENNEN, GREG SCHMITT, JOSH HOVEY, RYAN INSKEEP, JOHN GIBSON
CITY STAFF IN ATTENDANCE:
TIM ZOLLINGER, City Attorney;
CONNIE JENSEN, City Clerk;
EILEEN DETRA, Treasurer;
BRUCE FRANKS, Chief of Police;
BRIAN STRIKE, Director of Public Works;
RHONDA CARTER, City Administrator
III. PLEDGE OF ALLEGIANCE: Mayor Swanson, led the Pledge of Allegiance.
IV. PUBLIC COMMENT:
Prophetstown resident and pastry chef, Ann Rice, presented to the council her wish to open a bakery/ice cream parlor on Main Street in the near future.
Mrs. Rice stated that she was hoping to rent the space that currently houses Scottee- Shirts. Mrs. Rice stated that the current renter would be relocating the business in the near future.
Prophetstown City Attorney, Tim Zollinger, stated that since Mrs. Rice is renting, she would have to complete a joint TIF application with the building owner, in order to request TIF funding.
V. ITEMS FOR CONSIDERATION AND POSSIBLE ACTION:
1. Consideration and Possible Action: to revisit what to do with the 510 Washington Street property.
Mayor Swanson stated that he would like to see a for sale sign on the property, with the phone number for city hall on it, for possible inquiries.
The council agreed to table further discussion on the matter until the August 2019 regular city council meeting.
2. Consideration and possible action: to discuss property on East 3rd Street and proposal of new salt bin.
The council agreed to table further discussion on the matter until the August 2019 regular city council meeting.
3. Consideration and possible action: to approve Ordinance #844 - 2019-2020 Appropriations.
MOTION: Motion to approve Ordinance #844 - 2019-2020 Appropriations.

4. Consideration and possible action: to approve Ordinance #845 - Ordinance Amending Chapter 8 of the City Code for the Regulation of Fences.
Prophetstown Public Works Director, Brian Strike, said that the amendment states that fences may no longer be put on a property line.
Mr. Strike stated that the offset needs to be 36” off of the property line.
MOTION: Motion to approve Ordinance #845 - Ordinance Amending Chapter 8 of the City Code for the Regulation of Fences. The amendment states that all newly installed fencing needs to by offset 36” from the property line. MOTION MOVED BY BAKER, SECONDED BY DRENNEN.
COUNCIL CONCURRED. MOTION CARRIED.
5. Consideration and possible action: to Approve Ordinance #846 - Ordinance Amending Chapter 30, Article V, of the City Code Relating to Permit Application Fees for the Planting or Removal of Trees and Shrubs on Public Property.
Mr. Strike stated that there is currently nothing in the ordinance regarding charging a fee for a permit that would allow a resident to plant or remove trees and shrubs on public property.
MOTION: Motion to Approve Ordinance #846 - Ordinance Amending Chapter 30, Article V, of the City Code Relating to Permit Application Fees for the Planning or Removal of Trees and Shrubs on Public Property. (Permit fee: $25.00) MOTION MOVED BY SCHMITT, SECONDED BY INSKEEP.
COUNCIL CONCURRED. MOTION CARRIED.
6. Consideration and possible action: to approve resolution #070919 MFT Funds.
Mayor Swanson stated that the approval of the resolution takes place on an annual basis.

7. Consideration and possible action: to approve Ordinance #847 - Ordinance Amending Chapter 24, Article III of the City Code Increasing Minimum Age for the Sale and Purchase of Tobacco Products, Electronic Cigarettes and Alternative Nicotine Products from 18 to 21.
Prophetstown City Attorney, Tim Zollinger, stated that the ordinance would bring the city code into compliance with the new state law that went into effect July 1, 2019.
Mr. Zollinger stated that the ordinance would continue to allow the city to have some enforcement for code violations.
Mr. Zollinger stated that when the new law was written, the state removed possession as an offense; a minor can be in possession of tobacco products, as long as they are not buying, selling, or consuming them.
MOTION: Motion to Approve Ordinance #847 - Ordinance Amending Chapter 24, Article III of the City Code Increasing Minimum Age for the Sale and Purchase of Tobacco Products, Electronic Cigarettes and Alternative Nicotine Products from 18 to 21.

8. Consideration and possible action: to approve 2007 Crown Victoria (former police vehicle) as Surplus Property.
MOTION: Motion to declare the 2007 Crown Victoria as Surplus Property, and approve Prophetstown Police Chief, Bruce Franks, to sell said vehicle in whatever method he deems appropriate.
MOTION MOVED BY INSKEEP, SECONDED BY SCHMITT.
COUNCIL CONCURRED. MOTION CARRIED.
9. Consideration and possible action: to approve the pay request for Law Excavating Inc. for the sidewalk project.
Mayor Swanson stated that Law Excavating, contracted for the sidewalk by the Stumble Inn, was requesting pay for $95,620.05.
MOTION: Motion to approve the pay request for Law Excavating Inc. for the sidewalk project, in the amount of $95,620.05.

VI. ITEMS FOR CONSIDERATION:
1. Discussion on vacating alleyways.
Mayor Swanson stated that in the near future, the city will be asked by the Farmer’s National Bank to vacate part of the alley that is by their ATM machine.
Mayor Swanson stated the bank has purchased the property formerly owned by Kyle Gibson (next to the mini-mart), the property formerly owned by Don Scott, as well as property across from the library.
Mayor Swanson stated that the Gibson property was purchased in order to allow trucks to enter and exit when there is a delivery for Shaw’s Market.
Mayor Swanson stated the entrance to the alley will be off of 3rd Street. Mayor Swanson stated that there may be another entrance off of Lafayette Street.
Mayor Swanson stated that the alley behind the library that goes to the north should continue to the highway.

VIII. REPORT OF DEPARTMENT HEADS:
1. Chief of Police – Bruce Franks: Chief Franks submitted his written report to the council prior to the July 2019 regular city council meeting.
2. Director of Public Works – Brian Strike: Mr. Strike submitted his written report to the council prior to the July 2019 regular city council meeting.
3. Financial Report: No financial report was given.
4. Library: Beth Jacobs gave an update regarding the Henry C. Adams Memorial Library.
5. Main Street: Eileen Detra announced upcoming Main Street events.
IX. NEW IDEAS FOR PROPHETSTOWN: 1. City Computer Security Backup
Alderman Greg Schmitt stated that issues concerning the city’s computers needs to be addressed.
Alderman Schmitt stated that he is concerned with the security and backup of the computers, should a hard drive fail.
Alderman Schmitt stated that he felt Prophetstown Police Officer, Jim Miller, has the expertise to make the needed changes.
Alderman Schmitt stated that Officer Miller would also be responsible for documenting the procedure for each department regarding backup.
Officer Miller stated that he would be willing to get the various departments computer systems up-to-date.
The council agreed to have Officer Miller do the work.
2. Community Development Block Grant Project
Mayor Swanson stated that Dan Pepin contacted him and let him know that the signed copy of the resolution submitted by the city was forwarded to Dave Copin at DCEO.
Mr. Pepin stated that DCEO is satisfied with everything the city has submitted.
Mr. Pepin stated that DCEO is closed until mid-July, and that a grant agreement will not be forthcoming until DCEO re-opens.
3. Stripe Machine
Mayor Swanson stated that the city received the new stripe machine that was purchased with a grant from the Moore Foundation.
