City of Galena Zoning Board of Appeals met July 12.

23Z‐2001 – CALL TO ORDER

Chairperson Rosenthal called the regular meeting to order at 6:30 p.m. in the Board Chambers at 101 Green Street on the 12th of July 2023.

23Z‐2002 – ROLL CALL

Roll Call: AYES: Baranski, Laity, Gates, Monahan, Jansen, Einsweiler, Rosenthal NAYS: None

ABSENT: None

Upon roll call, the following members were present: Jim Baranski, Bill Laity, Roger Gates, Steve Monahan, Dave Jansen, Desiree Einsweiler, & John Rosenthal

Also present were Jonathan Miller and Joe Nack

23Z‐2003 – ESTABLISHMENT OF QUORUM

Chairperson Rosenthal announced a quorum of board members were present to conduct city business.

APPROVAL OF MINUTES

23Z‐2004 – APPROVAL OF THE MINUTES OF THE REGULAR ZONING BOARD OF APPEALS MEETING OF JUNE 14, 2023

Discussion: None

Motion Einsweiler moved, seconded by Monahan to approve the minutes of the regular Zoning Board of Appeals meeting of June 14, 2023

The motion carried by a voice vote. Janson abstained.

UNFINISHED BUSINESS

Cal. No. 23S‐02 & 23S‐03 Owner: Galena Brewery Properties, LLC and Applicant: Galena Lions Den. Reading of the Finding of Facts for a Special Use Permit to allow Outdoor Dining & to allow Outdoor Entertainment as an accessory commercial land uses in the Downtown Commercial District at 109 S. Main St.

Gates recused himself and left the room to a closed office.

Rosenthal read conclusions, determination, and the decision to approve from the finding of facts in the agenda.

DECISIONS

Cal. No. 23S‐02

NOW, THEREFORE BE IT RESOLVED, that this Zoning Board of Appeals has determined that this request by the Galena Lions Den for a Special Use Permit to allow Outdoor Dining as an accessory commercial land use in the Downtown Commercial District should be approved.

Motion: Monahan moved, seconded by Jansen to approve the finding of fact to approve the request.

Roll Call: AYES: Laity, Monahan, Jansen, Einsweiler, & Rosenthal

NAYS: None

ABSTAIN: Baranski

ABSENT: None

RECUSED: Gates

The motion carried.

Cal. No. 23S‐03

NOW, THEREFORE BE IT RESOLVED, that this Zoning Board of Appeals has determined that this request by the Galena Lions Den for a Special Use Permit to allow Outdoor Entertainment as an accessory commercial land use in the Downtown Commercial District should be approved with the following conditions.

1. Outdoor Entertainment shall not operate past 9:00 p.m. on weekdays and 10:00 p.m. on weekends.

2. There shall be no sound amplification, and the outdoor entertainment shall be limited to walking tours.

3. All patrons shall enter and exit through the Main St. side of the building except for in the case of an emergency.

4. No music shall be permitted.

5. The occupant load of the permitted space shall be limited by City of Galena adopted building codes.

Motion: Monahan moved, seconded by Jansen to approve the finding of fact to approve the request

NAYS: None

ABSTAIN: Baranski

ABSENT: None

RECUSED: Gates

The motion carried.

NEW BUSINESS

Gates returned to the meeting table from the closed office.

Rosenthal reminded all to sign in if they wished to speak.

Cal. No. 23V‐01 Owner: Lemfco Inc. and Applicant: Galena Mill and Steel. Request for a Variance to allow a sign on an existing storage tank in the Planned Commercial District at 185 S. Commerce St.

Einsweiler and Baranski recused themselves and went to a closed room.

All those wishing to speak at the public hearings were sworn in by Attorney Nack.

Motion: Jansen made a motion to open the public hearing, seconded by Gates.

Motion carried by voice vote.

Speaking in Favor of the Application

Applicant, Ryan McClain, 1810 N Cross Rd, Galena, IL. I want to put a sign on a tank behind the Lemfco property/ old Kraft building on an existing unused tank.

Discussion‐

Rosenthal asked if it would be an actual painted sign on the tank?

McClain explained colors they plan to use and that it will have 12‐ince high Victorian style letters. Gates asked if the sign would exceed 32 square feet.

Rosenthal where it will be located on the tank.

McClain about 2 ½ Feet from the top of the tank.

Rosenthal asked if anyone else wished to speak in favor and no one stepped forward.

Rosenthal asked if anyone wanted to speak in opposition and no one stepped forward.

Motion: Jansen moved, seconded by Gates to close the Public Hearing.

Motion carried.

Monahan made a motion to approve the variance for the painting up to the maximum 32 square feet of signage on the tank as approved by code for wall signs.

Roll Call: AYES: Monahan, Jansen, Laity, Gates, & Rosenthal

NAYS: None

ABSTAIN: None

ABSENT: None

RECUSED: Einsweiler & Baranski

The motion carried.

Einsweiler & Baranski returned to the meeting from the closed office.

22Z‐2005 – PUBLIC COMMENTS

NONE

22Z‐2006 – ADJOURNMENT

Motion: Jansen moved, seconded by Gates to adjourn.

The motion carried on a voice vote.

The meeting was adjourned at 6:43 p.m.
