City of East Dubuque City Council met Dec. 17.

Here is the minutes provided by the council:

1. 18-1215 Call to Order – Acting Mayor: Alderman Arling, Alderman Degenhardt, Alderman Digman, Alderman Havner, Alderman Robey, Alderman Vanostrand

2. 18-1216 Speakers from the Floor

NEW BUSINESS: 3. 18-1217 Discussion and Possible Action to Approve Coin Operated Machine License / Acting Mayor Robey, Interim City Manager Herrig

• Mayor Robey: This is the clean-up from last week.

• Motion made by Alderman Degenhardt and seconded by Alderman Arling to Approve Coin Operated Machine License, six ayes, motion carried.

4. 18-1218 Discussion and Possible Action to Pass an Ordinance Approving Membership in the Illinois Municipal League Risk Management Association and Authorizing the Execution of an Intergovernmental Cooperation Contract in the City of East Dubuque, Jo Daviess County, Illinois / Acting Mayor Robey, Interim City Manager Herrig ROLL CALL

• Mayor Robey: This is the ordinance that goes along with the acceptance for the insurance carrier.

• Motion made by Alderman Digman and seconded by Alderman Vanostrand to Pass an Ordinance Approving Membership in the Illinois Municipal League Risk Management Association and Authorizing the Execution of an Intergovernmental Cooperation Contract in the City of East Dubuque, Jo Daviess County, Illinois, six ayes, motion carried. ROLL CALL: Alderman Arling, Alderman Degenhardt, Alderman Digman, Alderman Havner, Alderman Robey, Alderman Vanostrand

5. 18-1219 Discussion and Possible Action to Approve East Dubuque Fire Department EMS Rate Increases / Acting Mayor Robey, Greg Schuster Fire Department

• CM Herrig: The goal was to clean up old accounts. Rates need to come up to conform with other ambulance services. The service charges will still be in line with others. Using this service should start heading in the direction of being sustainable without having to borrow again.

• Motion made by Alderman Arling and seconded by Alderman Degenhardt to Approve East Dubuque Fire Department EMS Rate Increases, six ayes, motion carried.

6. 18-1220 Discussion and Possible Action to Approve Liquor License, Restaurant License, Video Gaming License and Coin Operated Machine License for New Ownership G&D Food & Brew Inc. / Acting Mayor Robey, Interim City Manager Herrig

• Mayor Robey: They are buying the existing corporation. This would be contingent upon the background check.

• Alderman Arling: Is this a 3:30 license and is this ok to do without it being family? Just asking because was asked by a citizen.

• City Attorney Terry Kurt: Yes, this is ok.

• CM Herrig: Will look at the ordinance more closely.

• Motion made by Alderman Arling and seconded by Alderman Digman to Approve Liquor License, Restaurant License, Video Gaming License and Coin Operated Machine License for New Ownership G&D Food & Brew Inc., six ayes, motion carried.

7. 18-1221 Discussion and Possible Action to Approve Special Event Permit for WingFest XV on Saturday August 10, 2019 with Street Closure 100-200 Block of Sinsinawa Avenue from 8 a.m. to Midnight / Acting Mayor Robey, Interim City Manager Herrig, EDGE Group

• Alderman Digman: Looking to get the date locked in for advertising purposes. Plans are to be the same as in previous years.

• Motion made by Alderman Degenhardt and seconded by Alderman Arling Action to Approve Special Event Permit for WingFest XV on Saturday August 10, 2019 with Street Closure 100-200 Block of Sinsinawa Avenue from 8 a.m. to Midnight, six ayes, motion carried.

8. 18-1222 Presentation and Discussion Proposed Pipeline Project Construction Site / Interim City Manager Herrig

• CM Herrig: Marcus Murphy Sunflower Enterprises, Keil Harbor. Was approached about using their harbor as access for materials.

• Chris: We will be utilizing the yard for office trailers and temp fuel, employee parking and storage for environmental materials. Would level the property and lay down rock, will also seal the driveway. Will line with silt fencing as well.

• Alderman Robey: Have had multiple residents contact the city concerning the traffic and noise as well as the dust from the road.

• Alderman Vanostrand: Will there be blockage against traffic?

▪ Will be using the 6th street for access along the tree line o Arling: Truck size?

▪ Mostly Pick-ups. There are 300 employees but there will be roughly 75 vehicles being parked on the property. o Robey: What about fuel regulations?

▪ Will goes to the state for permitting. Will have to comply with regulations pertaining to fuel containment. Have been working with the fire department and Joe seems to have had all his concerns addressed. o Alderman Vanostrand: Concerns with back up alarms on the trucks in the residential area?

▪ Yes, the trucks do have the alarms, and this would be happening a little after 7am. The hours of operations are from 6am-6pm o Dawn Stepflug: Have family that lives there and there have been problems with

Newt not doing what they said they were going to do. o CM Herrig: The current zoning guidelines give us some control over operations on the property. Please clarify the operations that will be taking place on the property.

▪ Chris: Safety training, parking, fueling up the trucks. Will be hiring at 50% here and bringing in the other half. Will stimulate the economy with lodging, food etc. Will work with the city if there are any problems and are very well respected. All trucks are equipped with GPS so if any problems arise, we can investigate.

o CM Herrig: Spoke with the PD about defining the intersections to and from the site. Would like to set up a meeting to address any concerns. Recommend approve.

• Motion made by Alderman Arling and seconded by Alderman Degenhardt to approve prosposed construction site plans, six ayes, motion carried.

9. 18-1223 Discussion and Possible Action to Further Define the Interim City Manager Position as a 6-Month Appointment Subject to Review on or Before 6/1/2019 / Acting Mayor Robey, Interim City Manager Herrig

• CM Herrig: Had conversation regarding parameters as far as the position is laid out, not a matter of 2 out of 6 not wanting me to be hired due to anything other than that. This is a six-month appointment. At that time, the position and performance would be reviewed and then the council would be obligated to decide on how to proceed.

• Motion made by Alderman Arling and seconded by Alderman Digman five ayes, one nay (Alderman Robey), motion carries.

10. 18-1224 Discussion and Possible Action on New Committee Structure / Acting Mayor Robey, Interim City Manager Herrig

• Mayor Robey: Last week there was a conversation on how the committee should be structures. Loras and I spoke and seems most of the time all the alderman are present at the meetings, we are looking at doing a committee of a whole.

• CM Herrig: This helps with communication and direction since everyone will be present. Will be structured to address all the areas in each committee but is will be as one.

• Alderman Arling: This would be your decision Mayor and am all for it.

COUNCIL & COMMITTEE REPORTS: 11. 18-1225 Staff Reports: Interim City Manager Report, Acting Mayor Report, Alderman Report

City Manager Report: I plan on doing a report to you for every meeting that will summarize what we are working on and provide some explanation for items on the agenda.

First of all, I want to express my appreciation and admiration of Lou Ann and Joan. They are a tremendous asset for our city and they have been great to work with as they try to bring me up to speed on everything. The only problem so far is they are going 60 miles per hour and I am going at 30 miles per hour. If they have patience, I will catch up.

18-1218 This is simply our ordinance to continue our relationship with our new insurance provider. This is routine.

18-1219 Greg has prepared a new rate structure for our ambulance service. These rates are acceptable and need to be raised. We will now be comparable to other area services. My goal would be to make our ambulance service totally self-supporting and to build reserves to cover future purchases without borrowing money.

18-1222 I need your help on this one. I have been working with Marcus Murphy and Gary Newt on a pipeline project. NICOR is replacing and upgrading a natural gas pipeline in our county. They want to lease land from Sunflower Enterprises off of 6th Street. We have included a lot of information for your review. This project would generate a substantial amount of money into the local economy. However, I want to protect the adjoining residential area from any harm. My initial recommendation is to approve the use but build in enough protections to protect our citizens.

18-1223 I had a conversation with John Digman about my position. John made some excellent points and based on that I would request that you pass a motion to establish the interim city manager position as a 6 month position that will be reviewed before 6-1-19. This will allow our team to get to know each other and get us thru our election. I am perfectly fine with this and would appreciate a unanimous vote of support. After our initial vote, I have been approached by our citizens and they have questioned why 1/3 of the city council doesn't want me here. I believe John and Adam stated that their objection was to the loose parameters and this would help to structure the position better. I will thank you in advance for your consideration of this matter.

18-1224 At our previous meeting, you discussed the committee structure. My research indicates that the structure and makeup of the committees is totally up to the mayor. I have discussed with Mayor Robey that it would be beneficial to me initially if we simply scheduled committee of the whole meetings. That way every one of you would be included in everything and we will all hear firsthand what needs to be discussed. This should keep the lines of communication open.

18-1227 I would like some guidance on employment contracts

Other Items Not On the Agenda IPAD Training The IPADS are here. How do you want to be trained? We could schedule a night for everyone or do it individually.

Audit We have discovered a minor problem with our audit pertaining to our sales tax revenue. It is a small matter that we are working on and we will make an audit adjustment when Joan and our auditor get the final numbers put together. I have worked with dozens of these situations in the past and we always get them resolved.

Health Insurance and Other Employee Benefits We have started working on our benefit package in preparation for employment negotiations. We are simply gathering data to determine how we compare on costs and benefits. We will keep you informed.

Fire Department Joe invited me to a firemen's meeting and they were very kind and asked me a number of questions.

DMATS Meeting I attended a meeting of the area transportation group. Two items discussed that pertain directly to us involved the Highway 20 corridor and a port study being worked on that includes us. I will keep you informed.

Development opportunities In the first two weeks, I have met with two developers on both residential and commercial development. I also met with WHKS and IIW on possible projects and discussed our Port project. Lots of opportunities for East Dubuque.

Mayor Report: Nothing at this time.

Alderman Report:

• Alderman Havner: When will these meeting be scheduled?

o Will be after the first of the year.

• Alderman Vanostrand: 2018 has been a very trying year and believes Mr. Herrig is the answer to our needs. Would like to make a recommendation to say the pledge before the meetings.

Committee Reports: Ordinance, Budget, Local Improvements, Planning, Civil Service, and Utilities Committee

13. 18-1227 Executive Session: 5 ILCS 120 Personnel Section 2(c)(1) Employment and Compensation ROLL CALL:

• Motion made by Alderman Degenhardt to enter executive session, seconded by Alderman Vanostrand. ROLL CALL: Alderman Arling, Alderman Degenhardt, Alderman Digman, Alderman Havner, Alderman Robey, Alderman Vanostrand.

• No Action taken from executive session.
