City of East Dubuque Zoning Board met Jan. 2.

Have an agreement that has been negotiated between the property owner and the city. This is for an agreement that essentially have the same force as an annexation. The only difference between them and other annexations we did in the past is that this one does not have property that is contiguous currently to the city. Annexation will occur when the property is contiguous otherwise this agreement is for 20 years and can be renewed indefinitely after that until such time it is contiguous with the city. This is a mutually beneficial agreement that provides city services in exchange for bringing valuable property into the city limits. We will be expanding water mains jointly between the city and Leibold’s, this part has been approved from the City Council. Contingent on the Pre-Annexation agreement. This property will be treated as part of the City of East Dubuque. In terms of paying property taxes and sales tax revenue.

C. Presentation from Pre-Annexation Agreement Applicant – Leibold North Properties, LLC

Dan Dreessens with Delta 3 Engineering – Have been working with Leibold North Properties as well as City Manager Seitz on this Pre-Annexation agreement. Initially Leibold came to the city to annex in but because of not being contiguous with the City of East Dubuque which was not possible. Leibold’s met with adjacent property owners to see if they would possibly annex into the city but was not successful.

Another main reason for this is for zoning and the need for water for their property. What they are looking at constructing on this parcel of land is the new office building with the workshop across state line. They will be doing a full site approvement will be a private drive into the property but will be built to city standards for when the time comes that they are within city limits.

This will be a 56/44 split for the cost of a 12-inch water main to the property. Will be for any future development from the property.

A. Findings of Fact / City Manager Bob Seitz

City Manager Bob Seitz – have the summary before you and was talked about earlier. This is a great example of a mutually beneficial agreement. It works for the city and works for the company. Beneficial to a company that has a great history with East Dubuque and a national reputation.

Recommendation in favor of Pre-Annexation with Leibold North Properties, LLC.

B. Discussion and Possible Action on Recommendation to City Council
